¶Ç, ÇÑÀÎȸÀåÀ» Çß´ø ÇÏ ¶ó´Â Àΰ£Àº, 1990³âµµ ¹ÌÁÖÅëÀϽŹ®»ç¸¦ À§Àå ÆÄ»ê(éÅÍ 7)À» ½ÃÄ×½À´Ï´Ù. ´ç½Ã ±âÀÚ´Â 1¸¸ ºÒ Á¤µµ ºúÀÌ ÀÖ¾ú°í, ¾ð·ÐÀÌ ÃµÁ÷Àε¥, ÆÄ»êÇÒ ÀÌÀ¯°¡ ¾ø¾ú½À´Ï´Ù. ÆÄ»ê¿ëÁö, º¯È£»ç ÀÇ·Úµµ ÇÏÁö ¾Ê¾Ò½À´Ï´Ù. éÅÍ 7µµ ¸ð¸¦ Á¤µµ ¿´½À´Ï´Ù. ¿¬¹æ¼ö»ç±¹¿¡¼­µµ À§Á¶ »çÀÎÀ¸·Î ÆǸíÀÌ ³µ½À´Ï´Ù.

¹Ì±¹ ? À̶óÅ© Ãß°¡ Æĺ´ ? À̶óÅ© ÀüÀï º¸´Ù ´õ ½É°¢ÇÑ ¿ì¸® ³»ºÎÀÇ ºÎÁ¤, ºñ¸®°¡ ¸¸¿¬µÇ°í ÀÖ½À´Ï´Ù. ¾î·µç, ¿ì¸® ÇÑÀΟ¿î¿¡ Àç¹ú À̶ó´Â ÇÑ »ç¶÷ÀÌ, ÁÖ¹ÎÀÇȸ¸¦ °³ÆÇÃÆ°í, »ç¹ýºÎ ±îÁö ³ó´ÜÀ» Çß½À´Ï´Ù. Dear Chief of the State Bar of California:

This is to file a complaint about a member of the State Bar of California, ¡°Andrew Kim¡± (Ki Hyun Kim: Korean Name, (SB# 147015)) whose office is located at 3540 Wilshire Blvd. Suite 1116, Los Angeles, CA 90010 (Tel. 213-386-4497). Please consider the below and promptly take appropriate actions.

First, I, a plaintiff, did not assign or contract with an attorney, Andrew Kim. However, Andrew Kim cheated me and he appointed Rev. Michael Lee as a plaintiff and submitted the declaration of assigning a plaintiff on Jan. 19, 2005. Michael Lee put his name on the list of co-plaintiffs on Jun. 18, 2002, but on that day, he immediately declared that he would cancel his qualification as a plaintiff. And with the reason that there is no attorney for plaintiffs, Michael Lee went out of the court. According to the exhibit, Michael Lee was already recognized by a judge that he had no qualification as a plaintiff on Jan. 14, 2003.

Second, Andrew Kim violated Rule 3-500 of California Rules of Professional Conduct by failing to keep me as a client reasonably informed and get my written approval for stipulation (Exhibit 2) as ordered by the court (Exhibit 3, p. 456). When there was a stipulation among attorneys at which I did appear, the court ordered Andrew Kim to inform me of it and get my approval. However, he did not even tell me about it.

Third, Andrew Kim violated Rule 3-110 of California Rules of Professional Conduct by recklessly and repeatedly failing to perform legal services with competence. While representing me in Simon Bae v. Korean American Federation of Los Angeles (Case No. BC 275912) at Superior Court of California, LA County, Andrew Kim did not apply any appropriate diligence. Most of all, he failed to prepare an important evidence for trial. The appellate court remanded the same case that I won at the first trial for the reason that the evidence (Translation of the bylaws from Korean to English) presented by my former attorney was untrustworthy because it lacked the appropriate certification and there was a discrepancy of page numbers. (Exhibit 2, p.8-9) The second trial court also mentioned this problem. However, Andrew Kim has never tried to resolve these problems by acquiring a new translation or fixing the defects of the original translation. In result, the translation was found inadmissible again, which was one of major reasons why I lost the case. (Exhibit 3, p.251-252) Moreover, Andrew Kim did not conduct any discovery to collect the appropriate evidence. The opposing party alleged that the directors meeting acquired two-thirds of the directors¡¯ votes at the meeting in question. The opposing party alleged that it was reflected in a meeting minutes but never presented any copy of such a minutes. In sprite of this circumstance, Andrew Kim has never conduct any discovery in order to collect appropriate evidence and disprove the opposing party¡¯s allegations. Because of these problems, I lost the second trial and had to appeal.

Fourth, even though I terminated Andrew Kim upon April 2, 2005 (Exhibit 4), Andrew Kim kept acting as my attorney and even filed a document with the court (Exhibit 4). I believe this is a breach of the retaining agreement between me and Andrew Kim and also a violation of any applicable professional rule.

Because of Andrew Kim¡¯s inappropriate representation in violation of professional rules, I lost the case and have been very severely harmed financially and emotionally. Therefore, I will deeply appreciate if you can consider this complaint and take appropriate actions.

I, an accuser, have accused Andrew Kim to you, the State Bar of California, several times since Jan. 2006 (Case No.: 05-07792), but you have rejected on it. Today, however, I have found new, surprising, additional facts and I accuse Andrew Kim to you, the State Bar of California. I wish you, the State Bar of California, would punish Andrew Kim immediately according to the law. Andrew Kim is already an immoral attorney in the Korean Community and he has a criminal record. I, an accuser, wish that you, the State Bar of California, would deprive Andrew Kim of his qualification to an attorney. I hope that you, the State Bar of California, would visit me, an accuser, directly and listen to my own testimony when you investigate this case. There was a fact in 2006 that you, the State Bar of California, only telephoned me and checked the case insincerely in my first accusing case to you. I wish strongly that you, the State Bar of California, would punish this bad immoral attorney, Andrew Kim severely who has cheated me having weakness in understanding English, and has faked documents.
